如何合法的终止lease?

去年九月入住现在的公寓,今年7月左右发现有蟑螂,thanks to 前任室友。。。给物业发了两次maintanence requests, 之后并没有很在意蟑螂这个问题,直到九月我和现任室友签了新lease 以后发现蟑螂的问题越来越糟糕,向物业第三次申请除蟑螂的request, bug expert 来treat 五天以后并没有明显的好转。

The cockroach issue is seriously putting our health at a risk! 如何能合法的终止掉这个lease?

以下是lease 里关于终止合同的部分内容:

 Should you still want to get out of your lease early, according to sections 10 and 11 of the lease, you are responsible for finding a new tenant that is acceptable to our office. You will continue to owe rent until your lease is cancelled. The lease cancellation will not be binding until a new tenant has been found and a signed lease has been returned to us.


There are two options when wanting to end your lease early:

1.      Cancellation: If accepted, the applicant will sign a new 12 month lease that will void out your current lease. Rent is subject to increase, and you will be charged a $200 cancellation fee.

2.      Assignment: We do not accept assignments unless there are at least four months left on the current lease. Rent will remain at your current rate. The new tenant agrees to take the unit as is. Both you and the new tenant would be responsible for rent and any damages through the end of your initial lease term.“

我的问题如下:

1. 当前这种情况下,我和现任室友确实有义务要帮landlord 找下一个租客吗?

2. 如果有义务帮landlord 找下一个租客,landlord 是否自己也有义务宣传当前的公寓以便找到下一个租客?

3. 按照合同里面写的,即使找到了下一个租客无论如何我和现在的室友都得支付$200 cancellation fee 是吗?

您好。如果你的房东未能履行合约中的维修义务,比如房顶漏水、出现感染病毒寄生虫等,一旦房东对严重损坏的房屋置之不理,威胁到你的基本生活和健康,并且这些问题不是由你本人造成的,那么你可以提前申请解约。比如,新罕布什尔州如果房屋出现床虱(bedbug)这类的问题,那么房客可以提前解约,不需要支付剩余的房租。
