现雇主bench 对 H1B transfer 的影响

你好,

尚未辞职,现任雇主已经超过60天没有发工资了,就是俗话说的bench, 由于新雇主是大公司,流程拖沓,耽误了很多时间, 最终H1B file 的时候 会在1月18号左右, 我能提供的上一张paycheck 是11月11号,但是现任雇主12月6号给打钱了,direct deposit 但是没有paycheck。公司强制我签personal leave letter, 我有email证明雇主还是把我当雇员,不断给我介绍新的项目, 而且我前11个月所得已经超过LCA上的工资标准了。我这样算是out of status 吗?

请问,我该怎么办? H1B transfer 会遇到什么问题。 如果被要求出境激活的话,有什么风险?

Hi,

My employer is benching me for more than 60 days, my last paycheck is Nov 11 2017. but there is a direct deposit from them on Dec 6 2017, no paycheck generated that time.  My employer did not revoke my H1B and constantly contact me regarding finding new projects, hence, considering me as an employee, I have lots of emails to proof, and they force me to sign unpaid leave letters.   But till Nov 11 2017, what I earned from paycheck is already more than annual salary on LCA.

Do I still consider out of status?

And I found a new offer and going through H1B transfer, but their process is slow and delayed by the holiday season, so my H1B file is targeting Jan 18, 2018.  Will I face any problem when transferring H1B? What should I do about it? If asked to activate H1B outside States, is there any risk involved to do so?
